Just to bring everyone up too speed.....
Right before I got completly fed up wity having these two vermin infest my computer, I was trying to help TIM wiht some problems he was having with the car he listed here..a Leading Edge T2....I forund he was running an offset pod with a regular hub, or vice versa, (can't remeber for sure) anyway, he was asking for help so I gave it...told him to bid the pod right for the hub he had or buy the corect hub.....Now bear in mind he has baan bragging about a new job he landed in a body shop. making good money supposedly.
He rplies withj "screw this hobby..it's too expensive" I asked what, you get half your suff free beiing it off people what coast? the internet access???
He understandibly got mad and signed off..LOL!...but it struck me that now that they are acctualy having to pay their way...they are about gone.... I know for a fact Josh SMITH from KGB felt sorry fo TIm and Gave him one of the orrigional Assasin cars, complete...not perfect, but it was all there...well first time out TIM breaks the bumper...writes Josh about a replacement, Josh quoted the kid TEAM pricing for his replacement....TIM gets rather upset because in his mind this bumper should be free since it broke so fast...LOL!

They think the world OWES them all the entertainment they can handle and more....all I can say

Where do I start with these, I just completed a transaction with these little bastards, and it took place threw rcUniverse. I traded Tim my rc10 gt for
his tekin dyno(junk) and a bunch of mod motors. First off he emailed the next day asking if I had sent the gt yet , I hadn't even recieved his address yet, dame fool. I then questioned how we would ship he said overnight and also said once he recieved a tracking number he would ship , so I thought fair enough if I dont recieve a tracking number the next day , I'll cancel. Well the next day came and no tracking number and I could not talk to tim only tom,
I told tom I was going to cancel , he begged me not to and went into the reason why Tim did not ship , his car blew up or something. So I talked to tim later that night and he said that he stated he was not going to ship until he
recieved the gt, and my emails stated otherwise. By this time it was too late they had already recieved the Gt , and for 2 days I questioned them about his shipment , finally saturday 2 days after he recieved the Gt he said he shipped.
So I asked for the tracking number and he said tim had it on him and he wasnt around, turned out they sent it standard mail and it took 2 weeks
to get here, punk! So finally it arrived Monday of this week and I open the box and inside is this dirty tekin dyno with only one motor clamp (broken)
no optical rpm reader, and after testing the load motor does even work.

He was supposed to send 7 or more mod motors and he only sent 5 motors and one arm.

His sale on rc universe said in the condition of item spot (working excelent)
he stated that it reads load,rpm,volts. Fraudulent statement i guess.

Well this forum seem like my only hope to recover my stuff , I read something about the FBI, well if you out there and you read this please contact me .

I would suggest you call the police in their city and file a complaint. If everyone did that who had problems then I would suspect that they would be more likely to do something about it.

Well they raced at the track i race at and they wont come back.. lol I can tell everyone where they work though. They work at salad time in plymouth IN i'm not sure ont the shift though, hope that will help some of you....

I live in ontario canada so , unless I take a road trip , I doubt I'll be having a face to face with tim. I posted A conversation i had with tim this morning but know its gone. here it is again.

I talked to Thom of the barth clan this morning and he told me they sold the GT
last week, and I hadn't even recieved my stuff till monday. I said well equivelent
cash value and they said , 50 because i put that on the shipping(to save tim money) I need to know legally when is a deal complete . Not sure but I dont think tim had the right to sell until i recieved my item.

Any thoughts???

Well go figure the punks are screwing around and are stalling , after tim said he was going to send the money last friday and then today . Still no money , talked to Tim's accomplise Tom who I feal is just as guilty and I will also be putting a report in to the FBI about him and will draw from the many post on this site and others , about his and tims unlawfull conduct. Well I hope they get what they deserve and ill be sending the cops back to Tims house tommorow. Thing that really sucks is that it is a really long drive to Indiana and I am not looking forward to it but eventually I will go down there and take care of business, if Tim doesnt resolve this.

the more I read about these felows, the hapier I am that I cut my ties. I got sickening to read them both winning that everyone else is lying about them...LOL!

I suspect that they are watching the "wanted to buy" boards, for people who are looking to swap for something they want, or just for cash, then they bamboosal some unsupecting person into supporting their needs.

Last time I talked with them, Tim was working in some body shop he wouldn't mention the name of....didn't refuse, but just gave generic answer when I typed in "MACCO?"
Not sure what they are up too now....except they constantly try to IM me with "yo" and "why you dissing us?" etc.....
I had them Blocked but I removed it so I could better keep an eye on them, should they decide to attempt to burn a friend.

It is a darn shame some labeling method can not be employed..over a year ago, I tried to help them when I was conned into beliving that this sort of thing was unintentional and they would make every deal on the up and up in the future....HAH!

They are at minimum a pair of strange ducks....LOL!

I aso think..."Hank I hope your reading this"...that all threads related to these two carry both THOM and TIM's names, Here is why...they allways seem to either blame the other for what has happened,..... or USE the other, as a go between...I may be DUMB, but I aint stupid!...these two,.... at least for internet screen/user name purposes...... act as one entity,.. and I feel they should be treated as if they we both one and the same person.

A while back Thom had asked me to sponsor him. I said if he was past all his evil deeds and such.OK give the kid a break.....I extended him a 30% discount...that was over 2 months ago, and would you belive it...even at 30% off ........nothing to request...why.....I don't take trades, or offer credit I assume...LOL!

The reference they made to a $75.00 fantom Mod motor should be a kick in the head, "attention getting wise", to most.
When was the last time you saw anyone, let alone two GUMBA's like Thom and Tim, pat full sugested retail for a mod motor?
They most I EVER spent retail was $57 - $60...and that was awhile ago.

It also shows they can't read, or it never worked well enough from the begining for them to know what they had...the TEKIN DYNO uses the same slave motor set up that a CE tubo dyno uses...a Stock armature, in a modified can, with timing set to zero degrees...SO>>>>>>> why $75.00????

All you need is a decent mod can and bearings...any used speed gems can is fine....and an old stock arm form a P2k, or green machine is fine too.....but neither of them would no that because it probably was grabbed from a trash can before the trade....LOL!

For what it is worth. They race at Finishline Pets and Hobbies in Laporte,IN. I have dealt with them too. All I know is there are a few people around here, that if they get ahold of them, nobody will have to worry about them again.

Well, I suppose I have only myself to blame. I bought an RC10 DS from Timmothy (AKA Thom) Barth. The car was supposed to be "RTR, less receiver". When it arrived, several parts shown in the pictures had been stripped out. What followed was, to say the least, interesting. To say the most, it was fraudulant internet trading, and will be reported as such. What follows, less all the delays, "who are you and why are you contacting me" responses and outright refusals to answer e-mails, is the latest in the long line of questionable transactions by this pair.

After a long delay, Tim said the car was shipped with all the parts; but he would check with the Post Office.

Tim said the Post Office had removed all the parts (fail safe, servos, etc) because they were contaminated with fuel. Interestingly enough, the Post Office delivered the car with 1/4 tank of nitro still in the tank.

Tim said he had to pay the Post Office for "decontaminating" the parts, in order to get them back; and he was broke.

Smelling a rat; but willing to pay $20.00 just for the fun of watching this play out, I paid him an additional $20.00. I don't mind paying for my fun, after all.

After a long delay, he said his brother was causing the trouble; and he was getting blamed. However, he agreed to send the missing parts.

After they didn't arrive, I finally managed to track him down. He said the parts had been shipped and delivered. I said something which loosely translated to that which smells not nice and is used as fertilizer; and asked for the delivery confirmation number, so I could sort it out myself.

Tim said the shipping company had lost the parts; and he had not used delivery confirmation.

No further contact, despite numerous tries.

I will now file a fraudulent internet transaction report with Paypal and the legal athorities. I will also contact my lawyer; and ask how busy he is these days. Eventually, the word will get around; and they will get what they deserve. This might actually be kind of entertaining; and I'm sure I will get more enjoyment from the proceedings than I paid for. If Hank will keep us posted as to the latest pseudonames being used by these two, it will help. Thanks; Ernie P. :cool:

There are two means of action in any dispute; legal and civil. Legal action involved a complaint that an actual crime has been commited, and action by the legal (police or other law enforcement) authorities. Civil matters are between individuals. Although they may deal in court, it is still a dispute between individuals, NOT the legal system and an individual.

In matters dealing with fraudulent action on the part of a seller, using interstate commerce, the federal authorities normally take charge in a legal issue. The FBI normally takes charge in matters dealing with internet fraud, because it is a matter normally dealing with different states; and therefore not exclusively germain to a single legal jurisdiction. The Federal Communications Commission may also become involved, because the crime deals with a communications medium (the internet).

A civil action may be instituted in the juristiction of the buyer in Small Claims Court (normally limited to amounts of less than $1,000-$1,200 dollars, though it varies from state to state). That simply involves going down to the local courthouse, filling out a few pieces of paperwork and paying a small fee. You are essentailly sueing the individual, and don't normally need an attorney. Proper notification must be made to the seller, normally through the mail or other means (local newspaper ad). The case will come to action in the buyers jurisdiction; and the seller must either appear in court, hire an attorney to represent him (he may still have to appear personally), or forfeit the case by his non-appearance.

Once the seller loses the case (through default if he doesn't appear to contest the action), a judgement is entered against him in the amount of the claim, PLUS your court costs, perhaps PLUS a small amount for your inconvenience and time, PLUS court fees, if any. The seller then must satisfy the judgement by paying up. Otherwise, to collect the judgement, you present the judgement to the sellers local law enforcement personnel (normally the local police or court bailiff); and they go out to his house and gather up enough personal effects to satisfy the judgement, PLUS their administrative costs of enforceing the judgement.

If the seller doesn't have any assets, you simply wait until he does (when he buys a car, house, whatever) and then serve the judgement. The judgement is a matter of court record, is widely viewed, and active until it is paid; and can follow the seller for the rest of his life, until satisfied. And, the unsatisfied judgement is part of the individuals credit history. No one wants to sell some one a car if it may be seized to satisfy the judgement; too many legal hassles are involved.

You can also enter a complaint with the USPS (if paid by check through the mail), Paypal (if appropriate), and various other entities that may have been involved in the transaction.

You also have the option of (legitimately) attempting to contact the individual to ask about the missing or mis-represented items. It may be that your only means of communication available, occurs when you see the individual attempting to sell something else on the internet. It would be entirely appropriate to break into the thread, merely to ask if the missing items have been sent; or ask about the status of your purchased items.
