for a 150.00 it wouldn't be worth the lawyer fees so i thought this would cost him more business then the money

if you win, go after the court fees as well ..

Place the claim in Small Claims Court, and you won't need a lawyer. Just remember to take all the documentation with you. Thanks; Ernie P.

So? Your choices are simple: Take your chances convincing a judge, or let them walk on it. Obviously, you bought *something* from them; otherwise, there wouldn't be a cancelled check in the first place. Now, they have to prove they send you the merchandise; or something of that nature. If nothing else, you will cost them more in time and effort, than they took from you.

If we all refused to allow people to cheat us, without any response or action on our part, they wouldn't do it. Why put up with being cheated? Think of it as a new hobby; getting justice. Just my opinion; but I don't think any of us should be teaching people that they can get away with stuff like that. If none of us accepted it, if we each did what we can, the problem would go away pretty fast.

I would gladly spend another $150.00 (but Small Claims Court should be a lot less than that) to recover the first $150.00. Even if I lost money on the deal, I'd make sure it cost them more than I spent. After all, the court would be where *I* live. As I said, its probably just my ornery nature, but I won't allow people to cheat me. I may lose, but I *will* fight. Do what seems right to you. Thanks; Ernie P.

If you sent the check via the United States Postal Service, I believe that might be considered mail fraud, which is a federal offense. Worth looking into anyway.

Problem with small claims is collecting....

I won a case for almost $500, but now try and collect.....

I would give 25% for someone just to collect...

PO would be your best bet...

and i thought that some one would see this let him know and he would be a real man and send the product that i paid for . What pisses me off is that he has a hobby shop in MO and would treat people like that.

Take a ride to the Hobby Shop with some friends, and talk to the guy face to face.
If anything, you can get the local officials involved... just bring your proof!

why dont you start having friends call, and have them tell him he needs to send you your parts. when he stops answering for them, get someone else to call, continually call from different numbers, untill hes at the point hes scared to answer the phone when it rings, maybe he will get the idea your not playing around

His numbers are 1-417-588-7222 at the shop he hasn't been answering there someone answers and always tell me Jeff is out and will call when he gets back(but he never comes back must be because he don't call )and the cell number that i only get the machine is 1-214-316-5004 . And if he lost my number it is 1-518-493-5103. My biggest problem is trusting people, i guess someday i will learn.

and my name is Neil Hanson from C+N Hobbies so if anyone calls you will have a name to give out thanks

1-417-588-7222 disconnected..Cell he answered as Jeff..But claims to have no knowledge of you or any transaction...Also stated he has no connection with R/C cars or related products..I would prosecute him if I were you!
